WICKES COMMUNITY PROGRAMME - TERMS AND CONDITIONS (UPDATED NOVEMBER 2024)
- In 2021, Wickes launched the Community Programme, a dedicated product fund to support local initiatives in helping them maintain and renovate community areas. By participating in the Community Programme, you agree that the following terms shall apply. These terms are reviewed and may be updated on an annual basis.
- The Community Programme is conducted by Wickes Building Supplies Limited, (Company Number 01840419) whose registered office is at Vision House, 19 Colonial Way, Watford, United Kingdom, WD24 4JL (“Wickes”).
- The Community Programme is aimed at supporting organisations seeking help for improvement projects, these include registered charities, Community Interest Companies (CICs), state-funded schools and pre-school organisations, community groups, and sports organisations, organisations based in the UK. The Community Programme will not support organisations promoting private gain, discriminatory practices, religious activities (unless benefiting the wider community), political causes, initiatives with corrupt practices, individual fundraising appeals, national/international emergencies, local authority projects.
- Participating organisations shall not use the donated supplies for any of the following purposes: re-sale, as part of a raffle or lottery, personal or commercial reasons. Businesses and ‘for profit’ organisations are not eligible to participate in the Community Programme.
- We reserve the right to cancel, amend, withdraw, terminate or temporarily suspend this Community Programme and these terms and conditions for any reason, including noncompliance with these terms and conditions.
- Wickes and/or its suppliers shall provide the supplies in good faith and working order, however, we cannot guarantee that replacements will be provided. In relation to products stocked and supplied by Wickes, the products may include obsolete, returned, or cosmetically damaged items.
- In relation to products offered via the donation selection process, stores may offer a curated selection based on project needs or allow organisations to choose specific items within budget constraints from time to time.
- Products are provided on an "as is" basis. Wickes makes no representations and gives no warranties as to the quality, condition, state or description of the donated items, or their fitness or suitability for any purpose. All implied statutory or common law terms, conditions and warranties as to the donated items are excluded to the fullest extent permitted by law.
- It is the responsibility of the organisation to collect the donated products from the store.
- Wickes shall not be held liable for any loss, or for any indirect, special, incidental, or consequential damages of any kind regardless of the form of action, whether in contract, tort (including negligence), strict product liability, or otherwise.
- Nothing in these terms and conditions shall be construed as an attempt to limit either party’s liability for death or personal injury caused by that party’s negligence or for fraud, or for any liability that may not be limited or excluded by law.
- Organisations acknowledge responsibility for the safe storage and use of donated items.
- Wickes may recommend organisations maintain relevant adequate liability insurance for specific projects.
- As part of the Community Programme, Wickes collects the following personal data: full name, email address and phone number. We may use your personal information in connection with the Community Programme to contact you in regards to public relations and marketing support, future donations and volunteering opportunities. At the point of collecting personal data, you can opt out of receiving communications from us in relation to the above. - Wickes may seek to publicise the donation under the Community Project and may therefore request approval from you to use relevant intellectual property, such as brand names and marks. Wickes shall collaborate with you to ensure all necessary consents are obtained from relevant individuals, including vulnerable people, prior to the use of any intellectual property.
- Ownership and usage rights for project photos/videos will be determined collaboratively with the organisation. Wickes will prioritise obtaining consent from all individuals involved, especially vulnerable persons. These terms and conditions are between you and Wickes. No other person shall have any rights to enforce any of the terms.
- The application and interpretation of these terms and conditions shall be governed by the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them.
